PRIVACY POLICY

NOVACCHI LLC (“NOVACCHI,” “we,” “us,” or “our”) operates www.novacchi.com and the online store, content, features, products, customer-support channels, and related services made available through the website (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information when you visit or use the Services, place an order, create an account, communicate with us, subscribe to marketing, or otherwise interact with NOVACCHI. If there is a conflict between this Privacy Policy and our Terms of Service regarding the collection, use, or disclosure of personal information, this Privacy Policy controls.

NOVACCHI LLC is the controller of personal information processed for our own business purposes. Shopify and certain other third parties may separately act as controllers or businesses for information they process for their own purposes, as described in their privacy notices.

Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy.

  1. PERSONAL INFORMATION WE COLLECT

“Personal information” means information that identifies, relates to, describes, or can reasonably be linked with you. It does not include information that has been anonymized or de-identified so that it cannot reasonably identify or be linked to you.

Depending on how you interact with the Services and where you live, we may collect or process the following categories of personal information:

• Contact information, such as your name, email address, telephone number, billing address, shipping address, and country or region.

• Order and commercial information, such as products viewed, searched for, placed in a cart or wishlist, purchased, returned, exchanged, or canceled; order history; transaction details; discount use; and product preferences.

• Payment and transaction information, such as payment method, billing details, payment confirmation, transaction identifiers, and fraud-screening results. Complete payment-card information is collected and processed by Shopify and the applicable payment provider. NOVACCHI does not intentionally store complete payment-card numbers on its own systems.

• Account information, such as login credentials, account settings, saved addresses, preferences, and account activity.

• Communications and customer-service information, such as messages, emails, telephone communications, product reviews, survey responses, warranty requests, return requests, photographs, videos, device information, or other materials you choose to send us.

• Device and technical information, such as IP address, browser type, device type, operating system, network connection, cookie identifiers, advertising identifiers, and other unique identifiers.

• Usage and online-activity information, such as pages viewed, links clicked, referring URLs, search terms, interactions with our website or advertisements, cart activity, session information, and the dates and times of visits.

• Approximate location information, such as a general location inferred from your IP address. We do not intentionally collect precise GPS location through the NOVACCHI website.

• Marketing and preference information, such as your communication preferences, consent records, advertising interactions, and inferences about products or offers that may interest you.

• Information you voluntarily provide, such as information submitted through promotions, surveys, reviews, social-media interactions, or customer-support requests.

If you voluntarily send us smartwatch readings or other wellness-related information while requesting customer support or warranty assistance, we use that information only as reasonably necessary to respond to your request, troubleshoot the product, provide service, prevent fraud, or comply with law. Please do not send us medical records or other sensitive information that is not necessary for us to assist you.

  1. HOW WE COLLECT PERSONAL INFORMATION

We may collect personal information from the following sources:

• Directly from you, including when you visit the Services, create an account, place an order, contact us, submit a review, request a return or warranty service, or subscribe to email or text-message marketing.

• Automatically from your browser or device through cookies, pixels, tags, software development kits, local storage, and similar technologies when you use the Services or interact with our communications or advertisements.

• From Shopify and our service providers, including payment processors, fraud-prevention providers, analytics providers, fulfillment partners, shipping carriers, customer-support providers, review platforms, email and text-message providers, and technology vendors.

• From advertising, marketing, referral, and social-media partners, which may provide information about interactions with our advertisements, campaigns, or social-media content.

• From other third parties, when permitted by law.

  1. HOW WE USE PERSONAL INFORMATION

We may use personal information to:

• Provide the Services and perform our contract with you, including processing payments, fulfilling and delivering orders, managing accounts, providing order updates, handling returns, exchanges, refunds, and warranty requests, and providing customer support.

• Personalize and improve the Services, including remembering preferences, recommending products, analyzing website and campaign performance, understanding customer use, testing features, and improving our products, website, advertising, and customer experience.

• Communicate with you, including responding to inquiries and sending transactional messages about orders, accounts, returns, warranties, security, or policy updates.

• Conduct marketing and advertising, including sending promotional email or text messages where permitted, measuring advertising performance, creating audiences, limiting repeated advertisements, and displaying advertisements that may be more relevant to your interests.

• Protect the Services and our customers, including authenticating accounts, processing payments securely, preventing fraud, detecting unauthorized or malicious activity, enforcing our policies, and protecting our rights and the rights of others.

• Meet legal and operational obligations, including maintaining business and tax records, responding to lawful requests, resolving disputes, enforcing agreements, defending legal claims, and complying with applicable law.

  1. LEGAL BASES FOR PROCESSING

Where applicable law requires us to identify a legal basis for processing, we generally process personal information on one or more of the following bases:

• Contract: Processing is necessary to provide requested Services or fulfill our agreement with you, such as processing and delivering an order.

• Legitimate interests: Processing is reasonably necessary for our legitimate business interests or those of a third party, such as operating and improving the Services, providing customer support, preventing fraud, securing our systems, conducting analytics, and marketing our products, provided those interests are not overridden by your rights and interests.

• Consent: You have given consent, such as for certain marketing communications, non-essential cookies, or personalized advertising where consent is required. You may withdraw consent at any time without affecting processing that occurred before withdrawal.

• Legal obligation: Processing is necessary to comply with law, legal process, tax, accounting, consumer-protection, or regulatory requirements.

• Protection of rights: Processing is necessary to establish, exercise, or defend legal claims or protect the vital interests, safety, and rights of you or another person where applicable.

  1. COOKIES AND SIMILAR TECHNOLOGIES

We and our service providers use cookies, pixels, tags, and similar technologies to operate the website, remember preferences, keep the Services secure, understand website use, measure performance, provide customer support, and conduct or measure advertising.

These technologies may include:

• Strictly necessary technologies required for checkout, account access, security, fraud prevention, shopping-cart functions, and core website operation.

• Functional technologies that remember preferences and improve website features.

• Analytics technologies that help us understand traffic, website use, purchases, and campaign performance.

• Advertising technologies that help us measure advertisements, build or exclude audiences, and display advertisements based on activity over time and across websites or services.

Where required, we request consent before using non-essential technologies. You can manage available choices through our cookie banner or browser settings. Blocking some technologies may affect website functionality.

Global Privacy Control signals and our data-sharing opt-out process are described in Section 12 below. Other browser “Do Not Track” signals are not consistently recognized because there is no uniform industry standard for them.

  1. SHOPIFY AND SHOPIFY NETWORK INTELLIGENCE

The Services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of the Services to provide and improve the ecommerce platform, checkout, payments, fraud prevention, analytics, personalization, and other services used by NOVACCHI and its customers.

We use Shopify features that may incorporate information from your interactions with our store, Shopify, and other Shopify merchants to help protect, operate, grow, and improve our business and provide enhanced services. These enhanced services may support personalization, analytics, store performance, fraud prevention, and more relevant advertising. Information submitted through or collected by the Services may be transmitted to Shopify and to service providers located in countries other than the country where you reside.

  1. ADVERTISING, ANALYTICS, EMAIL, AND TEXT MESSAGES

We may work with analytics and advertising providers, including Google and Meta, to understand use of the Services, measure campaigns, prevent fraud, create or exclude advertising audiences, and display or measure advertisements. These providers may use cookies, pixels, tags, device identifiers, and similar technologies to collect information about your browser, device, interactions with the Services, purchases, or interactions with advertisements. Their processing is also governed by their own privacy notices.

If Microsoft Advertising Universal Event Tracking is enabled on the Services, Microsoft may receive information such as page visits, product views, cart activity, purchases, device and browser information, IP address, cookie or advertising identifiers, and interactions with Microsoft advertisements. Microsoft may use that information to measure advertising performance, create or exclude audiences, prevent fraud, and personalize advertising in accordance with its privacy statement at https://privacy.microsoft.com/privacystatement.

Depending on the circumstances and applicable law, disclosures to advertising partners may be considered a “sale,” “sharing,” or processing for “targeted advertising,” even though we do not sell personal information for money. You may opt out as described in Section 12.

If you subscribe to promotional email or text messages, we and our communications providers use your contact information and interaction information to deliver, personalize, and measure those communications. You may unsubscribe from promotional emails by using the unsubscribe link in an email. You may opt out of promotional text messages by following the instructions in the message, including replying STOP where supported. We may continue sending non-promotional messages concerning your orders, account, service requests, or our ongoing business relationship.

  1. COMPANION SMARTWATCH APPLICATIONS

Certain NOVACCHI products connect to third-party companion applications, which may include Da Fit, GloryFitPro, and NX Wear. NOVACCHI does not operate or control these applications. The available companion application depends on the product model.

Depending on the application, device, permissions you select, and features you use, a companion application may request access to or process information such as account details, device identifiers, Bluetooth information, approximate or precise location, activity and exercise information, sleep information, heart-rate or blood-oxygen readings, menstrual-cycle information, height, weight, age, sex, contacts, call or message notifications, and other phone permissions.

The independent collection and processing performed by a companion application is governed by the application developer’s privacy policy, not this Privacy Policy. Current privacy-policy links supplied by the application providers are:

NOVACCHI may receive companion-application information if you choose to provide it to us in a customer-support or warranty request, or if an application provider transmits information to us to provide a service you request. Any companion-application information that NOVACCHI actually receives is processed as described in this Privacy Policy.

We encourage you to review the applicable application’s privacy policy and permission settings before use and to grant only the permissions needed for the features you choose.

NOVACCHI products and companion applications are intended for general wellness and informational purposes and are not substitutes for professional medical advice, diagnosis, monitoring, or treatment.

  1. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information in the following circumstances:

• Shopify and service providers. We disclose information to Shopify and vendors that perform services for us, including ecommerce hosting, payment processing, fraud prevention, data analytics, cloud storage, information technology, customer support, product reviews, email and text communications, fulfillment, warehousing, shipping, returns, and professional services.

• Advertising and marketing partners. We may disclose device, usage, commercial, and contact information to advertising, analytics, social-media, referral, and marketing partners to measure campaigns, provide advertising, or perform services, subject to applicable consent and opt-out rights.

• At your direction or with your consent. We disclose information when you request or authorize us to do so, including to fulfill and ship an order, connect with a third-party service, publish a review, or interact with a social-media feature.

• Legal, safety, and compliance purposes. We may disclose information to comply with law or valid legal process; respond to government or law-enforcement requests; investigate or prevent fraud, illegal activity, security incidents, or policy violations; enforce our agreements; or protect the rights, property, and safety of NOVACCHI, our customers, or others.

• Business transactions. We may disclose information in connection with a proposed or completed merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to applicable law.

We do not sell personal information for money. However, as explained above, certain advertising or analytics disclosures may be treated as “sale,” “sharing,” or targeted advertising under some privacy laws.

  1. THIRD-PARTY WEBSITES AND SERVICES

The Services may link to websites, applications, social-media platforms, payment services, or other services operated by third parties. We do not control and are not responsible for the privacy, security, accuracy, or practices of third-party services. Review the privacy notice and terms of any third-party service before providing information or enabling permissions.

  1. SECURITY AND RETENTION

We use administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Do not send sensitive or confidential information through unsecured channels.

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to maintain your account, provide the Services, complete transactions, support returns and warranties, maintain tax and accounting records, prevent fraud, resolve disputes, enforce agreements, and comply with legal obligations.

Retention periods vary depending on the type of information, our relationship with you, applicable limitation periods, and legal requirements. We may retain de-identified information where it cannot reasonably be linked to you.

  1. YOUR PRIVACY RIGHTS AND CHOICES

Depending on where you reside and subject to applicable exceptions, you may have some or all of the following rights:

• Access or know: Request access to or information about personal information we maintain about you, including categories, sources, purposes, and recipients.

• Delete: Request deletion of personal information we maintain about you.

• Correct: Request correction of inaccurate personal information.

• Portability: Request a portable copy of certain personal information.

• Restrict or object: Request restriction of, or object to, certain processing.

• Withdraw consent: Withdraw consent where processing is based on consent.

• Opt out of sale, sharing, or targeted advertising: Opt out of uses or disclosures treated as sale, sharing, or targeted advertising under applicable law.

• Limit certain uses of sensitive personal information: Request a limitation where this right applies.

• Appeal: Appeal our denial of a privacy-rights request where applicable.

• Lodge a complaint: Complain to the data-protection authority or regulator where you live.

You may also use the Shopify Privacy Portal at https://privacy.shopify.com/ for choices relating to information Shopify processes for its own purposes.

If you visit our website with a legally recognized Global Privacy Control signal enabled, we process the signal as an opt-out request for the browser and device sending the signal where required by applicable law. If Shopify can associate that browser or device with your Shopify account, Shopify may also apply the choice to the account. We will not discriminate against you for exercising an applicable privacy right. We may need to verify your identity before completing a request. Verification may require matching information you provide with information already maintained by us. We will request only information reasonably necessary to verify and process the request.

Where permitted, you may designate an authorized agent to submit a request. We may require proof of the agent’s authority and may ask you to verify your identity or confirm the request directly. We will respond within the time required by applicable law.

  1. UNITED STATES STATE PRIVACY DISCLOSURES

Residents of certain U.S. states may have rights regarding access, deletion, correction, portability, opt-out of sale or sharing, targeted advertising, sensitive personal information, and appeals, subject to the scope and exceptions of applicable law.

During the preceding 12 months, we may have collected the categories of personal information described in Section 1 from the sources described in Section 2, used them for the purposes described in Section 3, and disclosed them to the recipients described in Section 9.

Depending on your interactions with us, these categories may include identifiers and contact information; customer-record information; commercial information; internet or other electronic-network activity; approximate geolocation; inferences; account credentials; payment and transaction information; and communications you choose to provide.

We do not knowingly sell or share the personal information of individuals under 16 years of age. We do not use information that we recognize as consumer health or wellness information to create advertising profiles or for targeted advertising.

You may exercise applicable rights through the methods in Section 12.

  1. INTERNATIONAL TRANSFERS

NOVACCHI is based in the United States. We, Shopify, and our service providers may transfer, store, and process personal information in the United States and other countries, which may have data-protection laws different from those where you live.

Where applicable law requires safeguards for an international transfer, we rely on recognized mechanisms, which may include adequacy decisions, the European Commission’s Standard Contractual Clauses, the United Kingdom’s International Data Transfer Addendum or equivalent approved clauses, and other lawful safeguards. You may contact us for additional information about applicable transfer safeguards.

  1. CHILDREN’S PRIVACY

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13.

If you are a parent or guardian and believe a child has provided personal information to us, contact us so we can review and, where appropriate, delete it. We do not knowingly sell or share personal information of individuals under 16 years of age.
